FIBA ASKED TO ENFORCE JUDGMENT AND TO IMPOSE SANCTIONS AGAINST HALCONES XALAPA - Jan 13, 2013

On December 6, the Basketball Arbitral Tribunal of FIBA ruled in arbitration (BAT 0294/12 Brown, Yam v/ Halcones UV Promotora Deportiva A.C.) that Halcones UV Xalapa owes their former player, Brandon Brown (201-F-85, college: CS San Bernar.) approximately $70,000 plus interest. On June 30, 2011, the parties entered into a guaranteed contract ("Agreement") for the 2011-2012 season. On September 23, 2011, the parties entered into a termination agreement providing for severance payments to be made to Brown. The agreed upon severance payments were never made. In thedecision by the arbitrator, he states, that "when the Parties entered into the termination agreement, it was expressed in clear terms that they were going their separate ways for agreed severance sums but that if those sums were not paid, the original financial obligations contained in the Agreement would be reinstated." The arbitrator ruled that when Halcones UV Xalapa failed to make the severance payments in the termination agreement, the financial obligations in the Agreement were revived and the arbitrator ruled that Halcones UV Xalapa owes Brown approximately $70,000 plus interest. Halcones UV Xalapa has failed to pay such judgment. Eurobasket has learned that based upon the team's failure to adhere to FIBA's decision, Brown's attorneys are requesting that FIBA enforce the judgment, levy additional fines and sanctions against Halcones UV Xalapa and block the team from signing new players in the future until the judgment is paid. Halcones UV Xalapa is currently in first place in Mexico with a record of 34-4 as they enter the playoffs as the #1 seed.

Soles de Mexicali (LNBP) landed 23-year old Venezuelan international forward Anthony Perez (206-97kg-93). He just graduated from Mississippi (NCAA). Perez has played there for the last four years. In 31 games he averaged 7.0ppg, 4.1rpg and 1.0apg last season. As mentioned above he is just out of the college and it will be his first season in pro basketball. Brooklyn Nets strengthened their training camp roster with addition of 28-year old Mexican international guard Jorge Gutierrez (190-88kg-88, college: California). It is actually his comeback to the Nets as he has played here before. Gutierrez is not a newcomer in USA League where he played most recently at Charlotte Hornets. Soles de Mexicali (LNBP) strengthened their roster with addition of 24-year old forward Carlos Perez (198-102kg-92). It is actually his comeback to Soles as he has played here before. Perez played in the summer at Fuerza Guinda de Nogales (CIBACOPA), but left. CIBACOPA was a little too high level for him, where in two games he did not score anything.
